These Terms of Service (“Terms”) govern your use of performancedieselgroup.com (the “Site”) and any purchase made from Performance Diesel Group, operated by Performance Diesel Group, LLC (“PDG,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old to make a purchase. By placing an order, you confirm that you are legally able to enter into a binding agreement.

2. Products and Fitment

We make every effort to display accurate product descriptions, images, specifications, and fitment information. However, manufacturers may change specifications without notice, and errors can occur.

You are responsible for confirming that a part is correct for your vehicle before purchasing and installing it. Before you order, check part numbers, year, make, model, engine, and any other fitment details. If you’re unsure, email parts@performancedieselgroup.com before ordering.

Product images are for illustration and may not reflect the exact item shipped.

3. Installation

Many of the products we sell require mechanical knowledge, specialized tools, and proper installation procedures. We strongly recommend that all parts be installed by a qualified diesel technician. PDG is not responsible for damage, injury, or failure resulting from improper installation, misuse, abuse, modification, or neglect.

4. Emissions and Legal Compliance

Some performance products sold on this Site are intended for off-road, racing, or competition use only and may not be legal for use on public roads or on vehicles subject to federal or state emissions regulations.

It is your responsibility to know and comply with all applicable federal, state, and local laws, including the Clean Air Act and any state emissions regulations (such as California’s CARB requirements), before you buy, install, or use any product. PDG makes no representation that any product is legal for use on your vehicle. PDG reserves the right to refuse or cancel any order that we believe may violate applicable law.

5. Pricing and Availability

All prices are listed in U.S. dollars and are subject to change without notice. Product availability is not guaranteed.

If a product is listed at an incorrect price because of a typographical, pricing, or system error, PDG reserves the right to cancel any order placed for that product, even after the order has been confirmed or your payment has been charged. If your payment has been charged, we will issue a full refund.

6. Orders and Payment

Your order is an offer to purchase. PDG may accept, decline, or cancel any order for any reason, including product availability, errors in product or pricing information, or suspected fraud. You agree to provide current, complete, and accurate purchase and account information.

Applicable sales tax will be added at checkout.

7. Shipping and Risk of Loss

Shipping times are estimates and are not guaranteed. PDG is not responsible for delays caused by carriers, weather, or other circumstances beyond our control. Title and risk of loss pass to you when the order is handed to the carrier.

Damaged shipments must be reported within 48 hours of delivery with photos, as described in our Return & Refund Policy. Freight and oversized items may be subject to additional shipping terms.

8. Returns, Refunds, and Warranty

All returns, refunds, exchanges, and warranty claims are governed by our Return & Refund Policy, which is part of these Terms. Warranty coverage is provided by the product manufacturer, and all warranty claims must go through PDG.

9. Disclaimer of Warranties

Except for any written warranty provided by the manufacturer, all products and the Site are provided “as is” and “as available.” To the fullest extent permitted by law, PDG disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, PDG is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Labor costs
  • Towing
  • Vehicle downtime
  • Lost income or business
  • Damage to other vehicle components
  • Rental vehicles

These limits apply to damages arising from the purchase, installation, use, or failure of any product. PDG’s total liability for any claim will not exceed the amount you paid for the product that gave rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless PDG, its owners, employees, and partners from any claims, damages, losses, or expenses (including attorney’s fees) that arise from:

  • Your use, installation, or modification of any product
  • Your violation of these Terms
  • Your violation of any law or regulation

12. User Accounts

If you create an account, you are responsible for keeping your login information confidential and for all activity under your account. Notify us right away of any unauthorized use.

13. Intellectual Property

All content on the Site, including text, graphics, logos, images, and product descriptions, is the property of PDG or its suppliers and is protected by copyright and trademark law. You may not copy, reproduce, or distribute any content without our written permission. Manufacturer names and trademarks belong to their respective owners.

14. Prohibited Use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site or its systems
  • Interfere with the Site’s operation
  • Submit false or fraudulent orders

15. Third-Party Links and Services

The Site may contain links to third-party websites or services. PDG is not responsible for their content, policies, or practices.

16. Governing Law

These Terms are governed by the laws of the State of TX, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in El Paso, TX.

17. Changes to These Terms

PDG may update these Terms at any time by posting the revised version on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
